Legal Defense for Injured Children

School, Sports and Playground Injuries

A school district’s administration owes a special duty to supervise and secure their premises for the children in their care. School personnel supervising students must exercise reasonable care appropriate to the circumstances. If not, they may be found negligent and responsible for the injuries suffered. If the school has knowledge of foreseeable student misconduct, they have a duty to protect other students from that misconduct.

While not every injury to a child participating in games or playground activities may be prevented, the school is responsible to establish a program for monitoring the activities of students on the playground and making sure the students are participating appropriately. The equipment and activity that schools allow students to participate in must be safe and appropriate to the particular age of the student.

Our office has successfully represented families against school districts for injuries and death to students by establishing that the school failed to follow reasonable safety standards exercised by similar school districts. We have also succeeded in forcing school districts to change policy to make sure that similar accidents were not repeated.
