DePuy Orthopedics, a division of Johnson & Johnson, has removed its DePuy Metal-On-Metal ASR Total Hip Replacement Systems from the market due to a high failure rate. Although DePuy acknowledged in March 2010 that there was a higher than expected failure rate with the DePuy ASR Hip implant, the recall did not occur until August 2010. We are now pursuing these claims on behalf of patients who received these implants.
Experts are questioning why DePuy did not recall the DePuy ASR Hip Replacement System earlier. Orthopedic surgeons had reservations about the design of the cups, which were difficult to implant in the hip properly. Orthopedic experts have suggested that the component has a narrow window for proper placement which is one explanation for the higher than expected implant failure rate when compared with other types of hip replacement implants. Like Zimmer implants, there is a real question as to whether the lure of profits pushed DePuy to offer the hip implants without properly testing whether the device would be safe and effective. Between 2008 and 2010 the FDA received approximately 300 complaints from patients within the United States. Many of these patients have had the device replaced, requiring another difficult operation for patients.

DePuy has attempted to head off claims by writing to surgeons who have implanted the device and providing contact information with DePuy’s designated claims company, Broadspire. You need your own representation and should not be left to deal with professional claims adjusters who work for DePuy.
